The text, which originated from a Colorado area code, was sent to Juror No. 1 after the closing arguments of the six-day trial, raising questions about its potential impact on the jury’s decision-making process.

The message was from an individual identifying herself as “Vanessa.” Initially, Juror No. 1 dismissed the message as spam. However, during jury deliberations, her concerns were reignited given that the trial involved defendants with ties to Colorado and a person mentioned in court shares the name “Vanessa.” This situation led U.S. District Judge William Hayes to summon the jurors back to court nearly two months after they had convicted Lopez.

The jury had found Patron guilty of charges connected to the 2020 murder of San Diego teenager Miguel Anthony Rendon in Tijuana. Following the jury’s verdict, five jurors testified that they were unaware of the text messages, while Juror No. 1, along with six others aware of the messages, maintained they viewed them as spam and asserted that the messages did not influence their verdict.

In a rare move, the jurors discussed the matter in court under oath at the request of Judge Hayes. Juror No. 1 expressed her initial wariness of the text messages and stated she reported them to a bailiff after the trial had concluded. Prosecutors filed a motion asserting that the messages were “innocuous” and had no relevance to the trial proceedings. In contrast, the defense argued that Juror No. 1’s concerns “tainted the entire panel,” calling for a new trial based on this issue.

The trial revolved around the brutal kidnapping and murder of Rendon, who had been involved in drug smuggling activities. Prosecutors described Patron as the gunman who fatally shot Rendon five times in the head. While other co-defendants had previously entered guilty pleas, Patron chose to face the court alone. During deliberations, Juror No. 1 communicated her worries about the text messages to fellow jurors, who reassured her that there was no cause for concern.

If the concerns about the text messages had been raised earlier, the court could have potentially addressed the situation by substituting Juror No. 1 with an alternate juror. After the trial, Juror No. 1 expressed anxiety that the messages could influence her judgment about the case. Judge Hayes now faces the task of determining whether the text messages had any prejudicial effect on the jury’s proceedings.

Juror No. 1 further speculated whether the messages were mere coincidences connected to the violent history of the case, which involved a high-profile murder. The jury deliberations lasted approximately five hours before reaching a unanimous verdict convicting Lopez of multiple charges. Depending on the outcome of the upcoming judicial hearings, this matter may be subject to review by the 9th U.S. Circuit Court of Appeals.

Sentencing for Patron is scheduled for August, while his co-defendants are set to be sentenced in July. Legal expert Professor Amy Kimpel highlighted the uncommon nature of questioning jurors after a verdict and noted the federal regulations designed to protect the confidentiality of jury deliberations.
