Bils, aged 36, had recently been arrested for allegedly brandishing a golf club at park rangers in Old Town State Park. After his arrest, he was transported to the San Diego Central Jail, where he managed to partially slip out of his handcuffs and escape from the vehicle of a California State Parks officer. The Bils family took further action by filing a wrongful death lawsuit, which was settled in mid-2022 for a sum of $8.1 million against San Diego County. This settlement underscores the family’s push for accountability in the wake of their loss and reflects broader concerns about policing practices.
Prosecutors assert that Russell failed to issue verbal commands or warnings prior to discharging his weapon, a key point in their argument against him. The defense, however, claims that Russell perceived a potential threat. They argue that Bils was seen holding an object, which was likely the loose left handcuff, and contend that the incident was a “tense, uncertain” situation that required quick decision-making.
Moreover, Russell’s defense suggests that he had no knowledge of the specifics surrounding Bils’ arrest and stresses that law enforcement training prioritizes monitoring the hands of suspects for any possible threats. Russell himself highlighted his lack of experience at the time of the incident, noting that his previous work had been primarily in courts and jail, and he had not been on patrol prior to this encounter.
